Applicability
This privacy statement applies to all sensitive information or personal data that you provide to us, for example through a registration form or the contact form on our website. We highly value the privacy of our clients and take the utmost care in handling and protecting personal data. We process data in accordance with the General Data Protection Regulation (GDPR). Fem is the data controller within the meaning of the GDPR for the processing of your personal data and those of your child. This means that Fem determines which data are processed, for what purpose, and in what manner. Fem is responsible for ensuring that your data and your child’s data are processed in a lawful and careful manner.
In this privacy statement, we explain which data Fem uses and for what purposes.
Personal Data We Process
Fem processes your personal data because you use our services and/or because you have provided this data to us yourself. We may process the following data:
- First and last name
- Gender
- Date of birth
- Address details
- Telephone number (landline or mobile)
- Email address
- Citizen Service Number (BSN)
- Health insurance policy number
- Other personal information you actively provide via correspondence or phone
- Medical data related to your pregnancy, childbirth, or postpartum care
Special and/or Sensitive Personal Data We Process
We store and use your personal data in order to provide proper care. We only share your data with third parties when necessary for the provision of that care. If the law requires explicit consent, we will ask for it in advance. We process your data based on the treatment agreement as described in the Dutch Medical Treatment Contracts Act (WGBO).
If you do not enter into a treatment agreement with Fem, we will explicitly request your consent for processing your data to be able to provide midwifery care.
This is done in accordance with the GDPR, derived from European Privacy Regulation EU 2016/679 (EPV).
Our website is not intended to collect data about visitors under the age of 18 unless they have parental or guardian consent. However, we cannot verify a visitor’s age. We recommend that parents or guardians monitor their children’s online activity to prevent data collection without consent.
Purpose and Legal Basis for Processing Personal Data
By agreeing to this privacy statement, you give explicit consent as referred to in Article 6(1)(a) of the GDPR for processing your personal data for the purposes stated below. You may withdraw this consent at any time. However, if you do not provide certain data or do not allow processing, we may be unable to provide you with proper service.
Fem processes your data for the following purposes:
- To provide midwifery care
- If applicable, to consult with other maternity care partners
- To send appointment confirmations and informational emails
- To call, email, or visit you when necessary for service delivery
- To inform you about changes to our services or products
Fem also processes data when legally required, such as for national registration systems like Peridos, Praeventis, SPRN, and current research projects.
Automated Decision-Making
Fem does not use automated decision-making that could have significant consequences for individuals.
Retention Period
Fem does not retain personal data longer than necessary. In accordance with the WGBO, the legal retention period for medical records is 20 years.
Sharing Personal Data with Third Parties
Fem may share personal data and your child’s data with third parties when compatible with the purposes listed above. Sharing data may be necessary to fulfill a contractual agreement with you or to meet legal obligations, such as national registrations.
Fem enters into data processing agreements with parties who process data on our behalf to ensure equivalent protection and confidentiality. We remain responsible for their actions. Outside of these circumstances, data will only be shared with your explicit consent.
Accessing, Modifying, or Deleting Data
You have the right to access, correct, or delete your personal data. You can also withdraw consent or object to processing and have the right to data portability. This means you may request that we send your data in a machine-readable format to you or a third party.
To submit such a request, email info@fem.nl. Please attach a copy of your ID for verification. Black out your photo, MRZ (machine readable zone), passport number, and BSN to protect your privacy.
We will respond as soon as possible, within one week.
If you request deletion of your data, we may no longer be able to provide responsible care. The WGBO requires that medical records be kept for 15 years. In this case, your data will not be deleted but marked as inactive.
